The Victim/Witness Assistance Program Brochure - Your Rights as a Crime Victim

In the 2023 Legislative Session, the Legislature passed CS/HB 667, and Governor DeSantis signed the bill on May 25, 2023. The act takes effect on July 1, 2023. This bill adds the right of each victim to be notified that he or she has the right, if contacted, to obtain information relating to a criminal proceeding by an attorney, investigator, or any other agent acting on behalf of the criminal defendant, to be informed of:

  1. The person’s name and employer and
  2. The fact that such person is acting on behalf of the defendant. (sec. 960.001(1)(v), Florida Statutes)

 

In addition to this new right, there was also an addition to an existing right as follows:

Law enforcement, prosecuting attorneys or any other government official cannot ask or require a victim of a sexual offense to submit to a polygraph examination or truth telling device.
